Terms of Service

These Terms of Service ("Terms") form a legally binding agreement between you ("you" or "your") and BaruzoTech ("BaruzoTech", "we", "us" or "our") and govern your access to and use of the Loan & Mortgage Calculator mobile application, together with any updates, content, and related services (collectively, the "App"). The App is distributed through the Apple App Store and Google Play.

Please read these Terms carefully. By downloading, installing, accessing, or using the App, you confirm that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not download, install, or use the App.

1. Definitions

  • App means the Loan & Mortgage Calculator application and all of its calculators, content, and updates.
  • Device means the smartphone, tablet, or other device on which you install or use the App.
  • App Store means the Apple App Store or Google Play, as applicable to your download.
  • Content means text, results, charts, and other materials made available in the App.

2. Eligibility

You must be at least the age of majority in your jurisdiction, or be a minor with the consent and supervision of a parent or legal guardian who agrees to these Terms, to use the App. By using the App, you represent that you meet these requirements.

3. Licence to Use the App

Subject to your compliance with these Terms and with the rules of the App Store you downloaded from, BaruzoTech grants you a personal, limited, non-exclusive, non-transferable, non-sublicensable, revocable licence to download and use one copy of the App on any Device that you own or control, solely for your own personal, non-commercial purposes.

4. Licence Restrictions

Except to the extent permitted by these Terms or by applicable law that cannot be excluded, you agree that you will not, and will not permit any third party to:

  • copy, modify, adapt, translate, or create derivative works of the App;
  • sell, rent, lease, lend, sublicense, distribute, or otherwise commercially exploit the App;
  • reverse-engineer, decompile, disassemble, or attempt to derive the source code of the App, except where this restriction is prohibited by law;
  • remove, obscure, or alter any proprietary notices, or use our name, logos, or trademarks without permission;
  • use the App in any way that breaches applicable law or the App Store rules, or that could damage, disable, or impair the App;
  • use any automated means to access the App or circumvent any technical limitations.

5. Intellectual Property

The App, and all intellectual-property rights in and to the App and its Content - including its software, design, text, graphics, and the "BaruzoTech" and app names and logos - are owned by BaruzoTech or its licensors and are protected by intellectual-property laws. Except for the licence expressly granted above, no rights are transferred to you, and all rights not expressly granted are reserved.

6. Not Financial Advice

The App provides general-purpose financial calculators for information, education, and personal planning only. The App does not provide financial, investment, tax, accounting, legal, or other professional advice, and no result should be treated as such. The calculators use the figures and assumptions you enter, together with standard formulas; they do not know your full financial circumstances and are not a substitute for professional advice.

Real-world outcomes depend on factors the App cannot know, including a provider's exact terms, fees, charges, rounding conventions, compounding and day-count methods, taxes, and changes in interest rates. You should always confirm any figure with your bank, lender, tax authority, or a qualified adviser before making a financial decision or entering into any agreement. You are solely responsible for any decision you make.

7. Accuracy of Results and No Reliance

We take reasonable care to implement the calculators correctly, but we do not warrant or guarantee that any result is accurate, complete, current, or suitable for a particular purpose. Results are estimates. You agree not to rely on the App as your sole basis for any financial decision, and you accept full responsibility for verifying any result before relying on it.

8. Availability, Updates, and Changes to the App

We may update, modify, add to, or remove features of the App at any time, and may release updates through the App Store, some of which may be required for the App to continue functioning. We may also suspend or discontinue the App, in whole or in part, without liability to you. We do not guarantee that the App will always be available, uninterrupted, or compatible with every Device or operating-system version.

9. Fees

The App is provided free of charge. If we ever introduce optional paid features, they will be clearly identified and subject to the payment terms of the applicable App Store at the time of purchase. Any purchases are processed by Apple or Google, not by us, and their terms govern billing, refunds, and cancellations.

10. Privacy

Your use of the App is also governed by our Privacy Policy, which explains that the App collects no personal data and runs on your Device. By using the App, you acknowledge the Privacy Policy.

11. App Store Terms

Your download and use of the App is also subject to the terms of the App Store you obtained it from, and those terms prevail over these Terms to the extent of any conflict regarding the download.

Apple App Store. If you downloaded the App from the Apple App Store, the following additional terms apply, and you acknowledge and agree that:

  • these Terms are concluded solely between you and BaruzoTech, not with Apple Inc. ("Apple"), and Apple is not responsible for the App or its content;
  • the licence granted to you is limited to a non-transferable licence to use the App on any Apple-branded product that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions;
  • Apple has no obligation whatsoever to furnish any maintenance or support services with respect to the App;
  • in the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the App; to the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the App;
  • Apple is not responsible for addressing any claims by you or a third party relating to the App or your possession and use of it, including (a) product-liability claims, (b) any claim that the App fails to conform to any applicable legal or regulatory requirement, and (c) claims arising under consumer-protection, privacy, or similar legislation;
  • Apple is not responsible for the investigation, defence, settlement, or discharge of any third-party claim that the App or your use of it infringes that third party's intellectual-property rights;
  • you represent and warrant that you are not located in a country that is subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties;
  • you must comply with any applicable third-party terms of agreement when using the App;
  • Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.

Google Play. If you downloaded the App from Google Play, your use is also subject to the Google Play Terms of Service and the applicable Google Play policies, in addition to these Terms.

12. Disclaimer of Warranties

To the maximum extent permitted by applicable law, the App is provided "as is" and "as available", with all faults and without warranty of any kind. BaruzoTech and its licensors expressly disclaim all warranties, whether express, implied, statutory, or otherwise, including the implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement, and any warranty arising from course of dealing or usage of trade. We do not warrant that the App will meet your requirements, be uninterrupted, timely, secure, error-free, or accurate, or that defects will be corrected. Some jurisdictions do not allow the exclusion of certain warranties, so some of these exclusions may not apply to you.

13. Limitation of Liability

To the maximum extent permitted by applicable law, in no event will BaruzoTech or its officers, employees, or licensors be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, savings, data, goodwill, or business, arising out of or relating to your use of, or inability to use, the App or any result it produces, whether based in contract, tort (including negligence), strict liability, or any other legal theory, and whether or not we were advised of the possibility of such damages.

To the maximum extent permitted by applicable law, our total aggregate liability arising out of or relating to the App or these Terms will not exceed the greater of the amount you paid us for the App (which is typically zero) or USD 10. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, such as liability for death or personal injury caused by negligence, or for fraud. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you, and you may have additional rights.

14. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless BaruzoTech and its licensors from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your misuse of the App, your violation of these Terms, or your violation of any law or the rights of a third party.

15. Termination

These Terms remain in effect while you use the App. You may end this agreement at any time by ceasing to use and deleting the App. We may suspend or terminate your licence immediately if you breach these Terms. On termination, the licence granted to you ends and you must stop using and delete the App. Sections that by their nature should survive - including intellectual property, disclaimers, limitation of liability, indemnification, and governing law - survive termination.

16. Changes to These Terms

We may revise these Terms from time to time, for example to reflect changes to the App, the law, or App Store requirements. We will post the updated Terms on this page and update the "Last updated" date above. Changes take effect when posted. Your continued use of the App after changes take effect constitutes acceptance of the revised Terms. If you do not agree to the changes, you must stop using the App.

17. Governing Law and Disputes

These Terms, and any dispute arising out of or relating to them or the App, are governed by the applicable laws of the jurisdiction in which BaruzoTech is established, without regard to conflict-of-law principles. You agree that the courts of that jurisdiction will have jurisdiction over any dispute, except that this does not deprive you of the protection of any mandatory consumer-protection rules of your country of residence, and either party may seek injunctive relief where available. Where required by law, you may also bring proceedings in the courts of your own country.

18. General

  • Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and BaruzoTech regarding the App and supersede any prior agreements.
  • Severability. If any provision is found unenforceable, the remaining provisions continue in full force, and the unenforceable provision will be modified to the minimum extent necessary.
  • Waiver. Our failure to enforce any right or provision is not a waiver of that right or provision.
  • Assignment. You may not assign or transfer these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
  • Force majeure. We are not liable for any failure or delay caused by events beyond our reasonable control.
  • Headings. Section headings are for convenience only and do not affect interpretation.
