These Terms and Conditions (“Terms”) govern your access to and use of BrandSnap (the “App”), provided by BaruzoTech Private Limited (“BaruzoTech,” “we,” “us,” or “our”). BrandSnap is a Canva app intended to help users extract brand-related assets from website URLs and use them in Canva designs.

By installing, accessing, or using BrandSnap, you agree to these Terms. If you do not agree, do not use the App.

These Terms apply to BrandSnap only. Your use of Canva is governed by Canva’s own terms and policies. If there is any conflict, Canva’s terms govern the Canva platform, and these Terms govern BrandSnap where not inconsistent.

1. Definitions

“App” means BrandSnap, including its features, interfaces, updates, and related services we provide.
“User” means any person or entity using the App.
“User Input” means information you provide to the App, including website URLs and selections.
“Website Content” means logos, images, icons, fonts, colors, CSS details, metadata, and other assets that may be accessible from a website URL.
“Extract” / “Extraction” means automated retrieval, parsing, analysis, or processing of Website Content to identify brand assets.

2. About BrandSnap

BrandSnap allows you to enter a website URL and attempts to extract certain brand-related assets that may be accessible from that website, such as:

Logos and icons (including favicons when available)
Images present on the website (where accessible)
Website color palettes
Font and typography information (as available through accessible website resources)

Results may vary. Not all websites expose assets in a way that can be reliably extracted. Extracted results may be incomplete, incorrect, outdated, or unavailable.

3. Eligibility

You must be legally capable of entering into these Terms to use BrandSnap. If you are using BrandSnap on behalf of a company or other organization, you represent that you have authority to bind that organization to these Terms.

4. Website Access Confirmation and Your Responsibilities

4.1 Permission to access and use website content

BrandSnap works by extracting Website Content from the website URLs you provide. You are solely responsible for ensuring you have the right and permission to access and use that Website Content for your intended purpose.

By using BrandSnap, you represent and warrant that:

You have permission to access the website URLs you provide to BrandSnap.
You have permission to extract and use Website Content obtained through the App.
Your use of BrandSnap and any Website Content complies with applicable laws and the website’s terms, rules, or policies.

4.2 Consent applies for future use

BrandSnap may show a one-time consent confirmation when you first use the App. By accepting it, you acknowledge that the confirmation applies to any website URL you use with BrandSnap in the future, unless you stop using the App.

4.3 No rights clearance

BrandSnap does not verify ownership, licensing, or permissions for Website Content. BrandSnap does not provide legal advice. If you are unsure, you should obtain permission from the website owner or relevant rights holder before using the content.

5. Acceptable Use

You agree not to:

Use BrandSnap to extract or use Website Content without required permissions.
Use BrandSnap in a way that infringes copyright, trademark, trade dress, or other rights.
Use BrandSnap for unlawful, harmful, deceptive, or fraudulent activities.
Attempt to bypass security controls, access restrictions, or rate limits.
Interfere with or disrupt the App, our systems, Canva, or third-party websites.
Use BrandSnap to collect personal data unlawfully or to scrape websites for personal data.

We may suspend or restrict access to BrandSnap if we believe you are misusing the App or violating these Terms.

6. Intellectual Property

6.1 BaruzoTech intellectual property

The App, including its software, design, branding, and related materials, is owned by BaruzoTech or its licensors and is protected by intellectual property laws. You may not copy, modify, distribute, sell, lease, reverse engineer, or create derivative works of the App except to the extent permitted by law.

6.2 Third-party website content

Website Content belongs to its respective owners and may be protected by copyright, trademark, and other laws. BrandSnap does not grant you any ownership rights in Website Content.

7. Free App and No Refunds

BrandSnap is currently provided free of charge. Since there are no fees, there are no refunds.

We may introduce paid plans or features in the future. If we do, we will update these Terms and provide applicable notices.

8. Third-Party Services and Websites

BrandSnap interacts with third-party websites that you provide and operates within Canva’s platform. We are not responsible for:

Third-party website availability, content changes, or restrictions
Any terms, policies, or rules imposed by third-party websites
The accuracy, completeness, or legality of Website Content
Any disputes between you and a website owner or rights holder
Canva platform outages, limitations, or changes that affect the App

9. Privacy

We may process User Input (such as website URLs) to operate the App, improve extraction quality, maintain security, and prevent abuse.

10. Disclaimers

BrandSnap is provided on an “as is” and “as available” basis. To the maximum extent permitted by law, BaruzoTech disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy.

We do not guarantee that:

The App will be uninterrupted, secure, or error-free
Extraction results will be complete, accurate, or available
Extracted assets are authorized for your use
The App will work with every website or URL

11. Limitation of Liability

To the maximum extent permitted by law:

BaruzoTech will not be liable for indirect, incidental, special, consequential, or punitive damages.
BaruzoTech will not be liable for loss of profits, revenue, goodwill, business interruption, or loss of data.
BaruzoTech’s total liability for any claim related to BrandSnap will not exceed INR 10,000.

Some jurisdictions do not allow certain limitations. In such cases, liability will be limited to the maximum extent permitted by applicable law.

12. Indemnity

You agree to defend, indemnify, and hold harmless BaruzoTech Private Limited and its directors, officers, employees, and contractors from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to:

Your use of BrandSnap
Your extraction or use of Website Content
Your violation of these Terms
Your violation of any law or third-party rights
Your breach of third-party website terms or policies

13. Termination

You may stop using BrandSnap at any time by uninstalling or discontinuing use.

We may suspend or terminate your access to BrandSnap if we reasonably believe you have violated these Terms or misused the App.

Sections that should naturally survive termination will survive, including intellectual property, disclaimers, limitation of liability, indemnity, and dispute terms.

14. Changes to These Terms

We may update these Terms from time to time. If changes are material, we may provide notice through the App, Canva listing, or our website.

Your continued use of BrandSnap after an update means you accept the updated Terms.

15. Governing Law and Dispute Resolution

These Terms are governed by the laws of India, without regard to conflict of law principles.

You agree that courts located in Surat, Gujarat, India will have exclusive jurisdiction over any disputes arising from or related to these Terms or the App, unless applicable law requires otherwise.

Before initiating legal proceedings, you agree to contact us to attempt to resolve the dispute informally.
